Pukka Putters: Full Terms and Conditions
1. General Website Use and Brand Identity
1.1 Acceptance of Terms
By accessing and using the Pukka Putters website, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must not use our website.
1.2 Intellectual Property
All content on this website, including but not limited to the Pukka Putters and The Professional Idiots names, logos, jungle course design, graphics, images, videos, and text, are the intellectual property of Pukka Putters and protected by copyright and trademark laws. Content may not be used, reproduced, or distributed without our prior written consent.
1.3 Limitation of Liability (Website)
Pukka Putters does not guarantee that the website will be free from errors or viruses. We accept no liability for any loss or damage arising from your use of the website or reliance on any information contained within it.
1.4 Relationship with "The Professional Idiots"
a. Separate Entity: Pukka Putters is an independent, separate legal and commercial entity from the content creators known as "The Professional Idiots." All contractual agreements (hire, ticket sales, venue partnership) are solely with Pukka Putters.
b. No Implied Appearance: The hire of the Pukka Putters course does not imply or guarantee an appearance, participation, or service from any member of "The Professional Idiots."
c. Social Media and Promotion: All official marketing is conducted through Pukka Putters’ own channels. "The Professional Idiots" are under no obligation to provide any promotional services or shares, and no such action is guaranteed in any hire package.


2. Private Hire & Events (Bespoke Quotes)
2.1 Quotations and Confirmation
a. Quote Validity: All bespoke quotes are valid for a period of 30 days from the date of issue.
b. Booking Confirmation: A booking is only confirmed upon receipt of a non-refundable deposit of 50% and the return of a signed booking agreement.
c. Final Payment: The outstanding balance must be paid in full no later than 30 days prior to the agreed event date. Failure to pay may result in cancellation and forfeiture of the deposit.
2.2 Client Venue Responsibilities
The Client agrees to ensure the venue meets all necessary requirements:
a. Access: Adequate space for the 60-foot double lorry to safely access, manoeuvre, and park at the event location.
b. Setup Area: A suitable flat, dry, and clean area for the 9-hole course and accompanying props.
c. Power: Access to a standard 13-amp power supply is required if the hire period exceeds three days.
2.3 Indemnity and Insurance
a. Client Indemnity: The Client/Venue agrees to fully indemnify and hold harmless Pukka Putters and its staff against all claims, liabilities, costs, and expenses (including legal fees) arising from any injury, damage, or loss to any person or property that occurs on the Client/Venue's site while the Pukka Putters course is present, except where such loss or damage is directly caused by the proven negligence of Pukka Putters' staff.
b. Client Insurance: The Client/Venue must hold and maintain valid Public Liability Insurance with a minimum coverage of £5 million for the duration of the hire period and must provide proof of such insurance upon request.
2.4 Cancellation by the Client (Hire)
Cancellations must be provided in writing. Refund amounts are subject to the following schedule:
a. 90+ Days Prior: Full refund of the balance paid, less the non-refundable deposit.
b. 30 to 89 Days Prior: 50% refund of the total hire fee, less the non-refundable deposit.
c. Less than 30 Days Prior: No refund of the total hire fee.
2.5 Cancellation or Modification by Pukka Putters
a. Force Majeure: Pukka Putters reserves the right to cancel or suspend services due to events outside our control (e.g., extreme weather, transport failure). In such cases, we will attempt to agree on an alternative date. If not possible, a full refund of all monies paid will be issued.
b. Safety: Pukka Putters reserves the right to close the course immediately if the environment is deemed unsafe for guests or equipment.
c. Reputation Protection: The Client/Venue agrees not to act in a manner that damages the professional appearance, goodwill, or reputation of Pukka Putters and/or the associated brand of "The Professional Idiots."


3. Public Ticket Sales (B2C)
3.1 Ticket Validity
Tickets are sold via a third party ticketing system and are valid only for the specific date and time slot purchased.
3.2 Refunds (Public Tickets)
All public ticket sales are final and non-refundable, except where the event or specific operating date is cancelled by Pukka Putters.
3.3 Attendance
If a customer fails to attend their specified time slot, they forfeit the ticket and no refund will be issued. Pukka Putters reserves the right to refuse entry to any person acting inappropriately or posing a risk to others.


4. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
